This Privacy Policy (“Privacy Policy”) governs the processing of your personal data collected via the website shop.repanels.com (“Website”) and when you communicate with us by e-mail, telephone, fax and social networks (“Social Networks”; e. g. Facebook, LinkedIn, and Instagram)

1 GENERAL INFORMATION

Your personal data are processed by Re Panels 3 SA, Avenue Arnaud Fraiteur 15/23, 1050 Brussels, under the number 0732.813.521 (“REPANELS”, “we”, “us”, “our”). You can contact us via e-mail at the following address: info@repanels.com.

  1. Where reference is made to certain laws or regulations, such reference shall also include any change, replacement or annulment of such laws or regulations, including any related executive decision.
  2. REPANELS reserves the right to update, change or amend this Privacy Policy from time to time. Such update, change or amendment will be communicated via the Website. If you do not accept the updates, changes or amendments, you must inform us by sending an e-mail to info@repanels.com. If we do not receive an e-mail from you within three (3) business days after we have announced the changes to our Privacy Policy on our Website, you will be deemed to have unambiguously accepted all such changes.

2 TYPE OF PERSONAL DATA WE PROCESS

  1. Each time you use our Website and Social Networks, we collect:
    1. technical information related to the device you are using, such as your IP address, browser type, geographical location and operating system;
    2. information about your browsing behaviour, such as the length of your visit, the links you click on, the pages you visit and how often you visit a page.
  2. When you fill in a contact form on our Website or contact us by e-mail, telephone, fax or via Social Networks, in particular when you contact us to create a customer account for your use, so that you can order our products directly from our Website, we collect:
    1. the basic identity information you provide to us, such as name, e-mail address, postal address, telephone number, company you work for, your position;
    2. the content of your communications, and the technical information of your communications themselves (the person with whom we communicate on our side, the date and time, etc.);
    3. your preferences regarding the receipt of our e-mail communications, such as newsletters, promotions, advertisements, etc., if you have chosen to receive these communications;
    4. your profile information on Social Networks made available to the public;

  3. We receive all personal data listed above from you directly. We may receive additional information about your preferences and browsing behaviour from partners such as Google, LinkedIn, Facebook and Instagram. 3 PURPOSE OF THE PROCESSING OPERATION

  1. REPANELS processes your personal data in order to provide you in a personalised and efficient way with the information about our products and services you request on the Website, by e-mail, telephone, fax or via Social Networks.
  2. REPANELS processes your personal data for marketing purposes, i.e. to provide you with our communications, promotions, offers and other targeted advertising. For this purpose, we may combine the personal data of our existing customers with information collected by our Website or Social Networks.
  3. Unless you are an existing customer who has already purchased similar products or services from us and to whom we wish to send our own marketing materials, REPANELS will only send you communications, promotions, offers, newsletters and other advertising by e-mail, or other personal electronic means of communication if you have explicitly consented to receive such communications, promotions, offers, newsletters and other advertising.
  4. REPANELS processes your personal data to create a customer account on our Website at your request so that you can order our products.
  5. When you order products or services via the Website, e-mail, telephone, fax or Social Networks, REPANELS processes your personal data to provide those products or services to you as well as for administrative and customer relationship management purposes.
  6. REPANELS processes your personal data to comply with legal obligations or to comply with any reasonable request from relevant officials or representatives of the police, judicial authorities, government agencies or governmental bodies, including relevant data protection authorities.
  7. Your personal data may be transferred at REPANELS's initiative to the police or judicial authorities in the event of reasonable suspicion of an illegal act or offence on your part when you register or use the Website, our Social Networks or other means of communication with us or used as evidence in legal proceedings.
  8. REPANELS processes your personal data to carry out statistical analyses so that we can improve our Website, products and services or develop new products and services, but also to manage our relationship with our customers.

REPANELS processes your personal data in order to protect its legitimate interests and those of its partners or a third party when your registration on or use of the Website, Social Networks or other means of communication can be considered as (a) a violation of any of the applicable terms of use or intellectual property rights or any other right of a third party, (b) a threat to the security or integrity of the Website, Social Networks or other means of communication, (c) a danger to the Website, Social Networks or other means of communication or to any of the underlying systems of REPANELS or its subcontractors due to viruses, Trojans, spyware, malware or any other form of malicious code, or (d) hateful, obscene, discriminatory, racist, defamatory, contemptuous, offensive or in any other inappropriate or illegal manner.

4 LEGAL BASIS FOR THE PROCESSING OF YOUR PERSONAL DATA

  1. In order to be able to process your personal data for the purposes indicated in clause 3.2, REPANELS, as a responsible party, requires your consent.
  2. The processing of your personal data for the purposes mentioned in clause 3.3 and 3.4 is necessary for performing an agreement between you and REPANELS. However, if you represent a legal person when creating an account or placing an order, then REPANELS relies on the necessity of the processing to pursue its legitimate interest in serving its customers.
  3. The processing of your personal data necessary for the fulfilment of the purposes set out in clauses 3.5 is necessary to enable REPANELS to comply with its legal obligations.
  4. The processing of your personal data necessary for the purposes set out in clauses 3.1, 3.6, 3.7 and 3.8 is necessary to protect REPANELS's legitimate interests, which are:
    1. to be able to respond to inquiries, requests or communications regarding our products and services;
    2. the continuous improvement of REPANELS's Website, Social Networks, products and services to ensure that you get the best possible experience;
    3. the protection of our Website, Social Networks, products and services against any misuse and illegal activity;
    4. the marketing and promotion of our products, services and brands.

5 RECIPIENTS

  1. REPANELS does not send your personal data in an identifiable manner to any third party without your explicit permission. However, you understand that if you use our Social Networks, your personal data are also processed by social network providers.
  2. REPANELS uses third party subcontractors to provide you with the Website and to process your personal data on our behalf. These third party subcontractors are only allowed to process your personal data on behalf of REPANELS on REPANELS's explicit written instructions. REPANELS guarantees that all third party subcontractors are carefully selected and are required to respect the security and integrity of your personal data.
  3. REPANELS shares your personal data with other entities within our group of companies. However, we will ensure that all entities ensure that any processing of your personal data complies with what is stated in this Privacy Policy.

6 PLACE AND TRANSFER

  1. REPANELS processes your personal data first and foremost within the EU. However, in order to process your personal data for the purposes set out in Article 3 above, we may also transfer your personal data to third parties who process them on our behalf and who are located outside the EU. Each entity outside the EU that processes your personal data is required to comply with adequate protection measures with regard to the processing of your personal data. These protective measures will be the consequence of:
    1. the introduction or establishment, by the recipient country, of legislation that can be considered equivalent to the protection offered within the EU; or
    2. a contractual arrangement between REPANELS and this entity.
  2. REPANELS may transfer depersonalized and/or aggregated data to organisations outside the EU. In this case, REPANELS will ensure that protective measures are in place to ensure the security and integrity of your data and that all rights relating to personal data that you may have under applicable mandatory legislation are observed.

7 QUALITY ASSURANCE

  1. REPANELS shall process only those personal data which are necessary for the purposes listed in Article 3.
  2. Your personal data will only be processed for the time necessary to achieve the purposes listed in Article 3 of this Privacy Policy or until you withdraw your consent. REPANELS will depersonalise your personal data when they are no longer necessary for the purposes set out in Article 3, unless there is:
    1. a prevailing interest for REPANELS or any other third party to keep your personal data identifiable;
    2. a legal or regulatory obligation or a judicial or administrative order preventing REPANELS from depersonalizing them.
  3. REPANELS will take appropriate technical and organisational measures to protect your personal data against unauthorised access or theft and against accidental loss, alteration or destruction. Only REPANELS staff or its third-party controllers who need to know your personal data will have access to it and they will be subject to strict confidentiality obligations. However, you understand that safety and security are best efforts obligations only.

8 YOUR RIGHTS

  1. You have the right to request access to all personal data processed by REPANELS that concern you. REPANELS reserves the right to charge administrative fees for several subsequent access requests that are clearly submitted in order to harm or cause nuisance to REPANELS. In such event REPANELS may also choose to refuse these subsequent requests.
  2. You have the right to request the rectification of any personal data concerning you that are inaccurate free of charge. In the event of a request for rectification, this request must be accompanied by proof of the erroneous nature of the data for which rectification is asked.
  3. You have the right to withdraw your earlier given consent for the processing of your personal data.
  4. You have the right to request the deletion of personal data concerning you if they are no longer necessary for the purposes set out above or if you withdraw your consent to their processing. However, you should keep in mind that REPANELS will assess your deletion request against:
    1. the overriding interests of REPANELS or any other third party;
    2. any legal or regulatory obligations or judicial or administrative orders that may conflict with such deletion.
  5. Instead of requesting the deletion of your personal data, you may also request that REPANELS limits their processing if and when (a) you dispute the accuracy of the data, (b) the processing is unlawful or (c) the data are no longer necessary for the purposes listed in Article 3 but you need them to defend yourself in legal proceedings.
  6. For the purposes mentioned in clauses 3.2, 3.3 and 3.4, you have the right to receive from us, in a structured, commonly used and machine-readable format, all personal data you have provided to us.
  7. Where we rely on our legitimate interests you have the right to object to the processing of personal data if you can prove that there are serious and well-founded reasons linked to particular circumstances guaranteeing such opposition. However, if the processing operation envisaged is a direct marketing operation, you have the right to object to such processing free of charge and without justification.
  8. If you wish to submit a request to exercise one or more of the rights listed above, you may send an e-mail to info@repanels.com. An e-mail requesting the exercise of a right shall not be construed as consent to the processing of your personal data beyond what is required for the processing of your request. This request must clearly indicate which right you wish to exercise and the reasons for the request. It must also be dated, signed and accompanied by a scanned copy of your valid identity card proving your identity.
  9. REPANELS will inform you promptly of the receipt of this request. If the request is valid, REPANELS will honour it as soon as reasonably possible and no later than thirty (30) days after receiving the request.
  10. If you have any complaints about REPANELS's processing of your personal data, you can always contact REPANELS at the e-mail address indicated in the first paragraph of this clause. If you are still not satisfied with REPANELS's response, you are free to lodge a complaint with the competent data protection authority, namely the Data Protection Authority (https://www.dataprotectionauthority.be/).
